1. ABOUT DUMAGUETE WELLNESS

Dumaguete Wellness is a wellness studio and lifestyle facility offering Pilates, movement and fitness classes, wellness treatments, recovery services and related facilities and products.

​

Our offerings may include Pilates Reformer, Mat Pilates, Strength Training, Yoga, specialised movement classes, private sessions, wellness treatments, recovery services, pool access, gym facilities, events and retail or food and beverage products.

​

Services, schedules, facilities and availability may change from time to time.

​

2. BOOKINGS AND APPOINTMENTS

​

All class, treatment, facility and event bookings are subject to availability and confirmation through our official booking system or other authorised booking channels.

​

Customers are responsible for ensuring that their booking details are accurate, including the selected service, date, time and contact information.

​

A booking is subject to the applicable payment requirements and the booking status shown in our system.

Customers must arrive on time for their scheduled sessions. Late arrivals may result in reduced session time or refusal of participation where necessary for safety or to avoid disrupting other customers.

Bookings are personal to the individual for whom they were made and may not be transferred to another person without prior approval from Dumaguete Wellness.

3. ACCOUNTS AND PERSONAL USE

​

Customers may be required to create an account to access bookings, memberships, packages, Club Wallet balances and other services.

​

Customers are responsible for maintaining accurate account information and keeping their login credentials secure.

​

Accounts, memberships, passes and purchased packages are intended for the registered customer only unless otherwise expressly stated.

Sharing accounts, login credentials, passes or benefits with other individuals is not permitted where this would violate the applicable package or membership conditions.

Dumaguete Wellness reserves the right to investigate suspected misuse, duplicate accounts or unauthorised sharing of account benefits and may restrict access where reasonably necessary, subject to applicable law.

4. PRICING AND PAYMENTS

​

All prices are displayed in Philippine pesos (PHP), unless otherwise stated.

​

Customers may pay for services individually per session, purchase a package, or choose to use the Dumaguete Wellness Club Wallet, subject to the available options and conditions displayed at the time of purchase.

​

Payments may be made through the available payment methods on our website or other payment arrangements authorised by Dumaguete Wellness.

​

Online payments may be processed by third-party payment providers, including Xendit, and may be subject to their applicable terms and security procedures.

​

Customers are responsible for checking their selected service, package and payment details before completing a transaction.

​

5. PACKAGES AND CLUB WALLET

​

Dumaguete Wellness offers different payment options to suit our customers' needs.

​

Pay per session: Customers may pay the applicable price for an individual class or service.

​

Packages: Customers may purchase available packages that provide access to a specified number or type of sessions, subject to the package conditions and validity period communicated at the time of purchase.

​

Club Wallet: Customers may choose to top up their Dumaguete Wellness Club Wallet and use the available balance to pay for eligible classes and sessions offered by Dumaguete Wellness.

​

The Club Wallet is consumable and may only be used for eligible classes and sessions. It cannot be used to purchase food, beverages or other excluded products.

​

All packages and Club Wallet usage are subject to the applicable prices, validity periods and conditions communicated at the time of purchase.

​

Customers can view and track their account activity, including bookings, package usage and Club Wallet transactions, through their Dumaguete Wellness account.

​

Customers are responsible for checking their account details and available balances. Any discrepancies should be reported to Dumaguete Wellness so they can be reviewed.

​

Packages and Club Wallet balances are intended for the registered customer and may not be shared or transferred unless expressly authorised by Dumaguete Wellness.

6. MEMBERSHIPS AND ACCESS PASSES

​

Dumaguete Wellness may offer memberships, access passes and promotional offers that provide access to specified classes, facilities or services.

​

Each membership or pass is subject to its advertised price, validity period, eligibility requirements, included benefits and usage conditions at the time of purchase.

​

Memberships and access passes may include selected classes, facilities or other benefits, depending on the specific membership purchased. Additional services may need to be paid for separately.

​

Bookings remain subject to availability and any applicable reservation rules or usage limits.

​

Memberships, access passes and promotional benefits are personal to the registered customer and may not be shared or transferred unless expressly permitted by Dumaguete Wellness.

​

Customers should review the relevant membership or pass details before purchasing.

​

7. CANCELLATIONS, LATE CANCELLATIONS AND REFUNDS

​

Bookings, cancellations, late cancellations, no-shows, rescheduling and refunds are governed by our separate Cancellation & Refund Policy, together with any applicable product-specific conditions.

​

Customers are responsible for reviewing the applicable policy before purchasing or making a booking.

​

Where a booking is cancelled by Dumaguete Wellness, we will communicate the available arrangements, which may include rescheduling, restoring the applicable amount to the customer's Club Wallet or issuing a refund, as appropriate to the circumstances and applicable law.​​

Nothing in these Terms & Conditions excludes any refund, remedy or other right that a customer is entitled to under applicable law.

8. HEALTH, SAFETY AND PARTICIPATION

​

Customers are responsible for assessing whether they are fit to participate in a class, exercise programme, treatment or wellness activity.

Please inform the relevant instructor or practitioner of any injury, physical limitation, relevant medical concern or other circumstance that may affect safe participation.

​

Customers should seek advice from an appropriately qualified healthcare professional before participating where they have concerns about whether an activity is suitable for them.

​

Participation in exercise, physical training, recovery activities and wellness treatments may involve inherent risks. Customers must follow all reasonable safety instructions provided by instructors, practitioners and staff.

​

Dumaguete Wellness may refuse or discontinue participation where reasonably necessary to protect the health and safety of a customer, other participants or staff.

​

Certain services may require the completion of an intake form, health declaration, consent form or separate waiver before participation.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

9. USE OF FACILITIES

​

Customers using our studios, gym, pool, recovery facilities, treatment rooms and other premises must comply with posted rules, staff instructions and applicable safety requirements.

​

Customers are expected to use equipment and facilities responsibly, respect other users and maintain appropriate hygiene.

Equipment must be used only for its intended purpose and in accordance with staff instructions.

​

Children and minors may be subject to additional supervision, consent and access requirements.

​

Access to facilities may be temporarily restricted due to maintenance, repairs, cleaning, safety concerns, operational requirements or circumstances beyond our reasonable control.

​

Dumaguete Wellness may refuse access to any person whose conduct presents a reasonable safety risk or materially disrupts the experience of other customers.

10. PERSONAL BELONGINGS AND PROPERTY

​

Lockers are available for customers to store their personal belongings while visiting Dumaguete Wellness. Customers are encouraged to use the lockers to secure their valuables and should ensure that their belongings are properly stored and that lockers are securely closed after use.

​

Customers remain responsible for their personal belongings, including items left in lockers or elsewhere on the premises. Dumaguete Wellness does not accept responsibility for lost, stolen or damaged personal belongings, except where such loss or damage results from our negligence or other circumstances for which we are liable under applicable law.

​

Customers should avoid bringing unnecessary valuables to the studio and should report any lost or missing items to our staff as soon as possible.

​

Customers may be held responsible for damage to equipment, facilities or property caused by their negligent, reckless or intentional conduct, subject to applicable law.

11. CUSTOMER CONDUCT

​

All customers, members, visitors and guests are expected to treat instructors, practitioners, staff and fellow customers respectfully.

Harassment, abusive behaviour, discrimination, threats, deliberate damage to property and conduct that compromises safety are not permitted.

Customers must follow reasonable instructions from staff and comply with applicable facility rules.

​

Where necessary, Dumaguete Wellness may suspend or restrict access, cancel a booking or take other proportionate action in response to serious or repeated misconduct, subject to applicable law and any relevant contractual rights.

12. WEBSITE AND ONLINE BOOKING SYSTEM

​

We aim to keep our website and booking system accurate and accessible. However, we cannot guarantee uninterrupted access or that all information will always be free from errors, delays or technical interruptions.

Class schedules, instructor assignments, prices and service descriptions may occasionally need to be updated or corrected.

​

If a technical error affects a booking, payment or account balance, please contact us so that we can investigate and resolve the matter appropriately.

Customers must not misuse our website, attempt unauthorised access, interfere with the booking system or use the website for fraudulent or unlawful purposes.

13. INTELLECTUAL PROPERTY

All content on the Dumaguete Wellness website and official communication channels, including text, logos, branding, photographs, graphics, designs and other materials, is owned by or used with permission by Dumaguete Wellness or the relevant rights holder.

15. CHANGES TO SERVICES AND THESE TERMS

Dumaguete Wellness may update its services, schedules, prices, facilities and operating procedures from time to time.

We may also amend these Terms & Conditions where reasonably necessary to reflect changes in our operations, services, legal obligations or business requirements.

The latest version will be published on our website with its effective date.

​

Changes will not retrospectively remove rights that customers have already acquired under applicable law or an existing agreement.

Nothing in these Terms & Conditions excludes or limits liability for fraud, gross negligence, wilful misconduct, personal injury or other matters where liability cannot lawfully be excluded or limited.

Customers retain all mandatory rights and remedies available under Philippine law.

18. FORCE MAJEURE

​

Dumaguete Wellness will not be considered in breach of these Terms & Conditions to the extent that performance is prevented or materially delayed by circumstances beyond our reasonable control, including natural disasters, severe weather, public emergencies, government restrictions, utility interruptions or other comparable events.

Where such circumstances affect a booking or service, we will take reasonable steps to communicate relevant changes and arrange an appropriate resolution in accordance with the applicable policy and law.

19. GOVERNING LAW AND DISPUTES

These Terms & Conditions are governed by the laws of the Republic of the Philippines.
